The following are terms and conditions of a legal agreement between you and Kickoff Group, LLC and its affiliates (collectively, “Kickoff Group”, “Gentle No More”, “we”, “us” or “our”). These terms and conditions govern your use of www.gentlenomore.com (the “Gentle No More Website” or “Website”).
Through procuring our products would mean that you have acknowledged, read, understood and agree to be bound by these “Terms and Conditions” and to comply with all applicable laws and regulations. If you do not agree with these Terms and Conditions, you should not use the Website and/or purchase Gentle No More products. Gentle No More reserves the right to update and change the Terms and Conditions, whether informed or uninformed, by posting updates and changes to Gentle No More website.
1. CHANGE OF THE WEBSITE, THE PRODUCTS & TERMS AND CONDITIONS
Gentle No More reserves the right to update, alter, modify or otherwise make changes to the Website, the Products and these Terms and Conditions at any time. Such amended Terms and Conditions shall be effective upon posting on this Website and will have no effect on sales that were completed before such posting. We will make reasonable efforts to post notices regarding any changes to these Terms and Conditions.
(i) Placing an order
By placing an order with Gentle No More, you are (i) offering to purchase a product, (ii) representing that you are of legal age to form a binding contract, and (iii) representing that all information you provide to us in connection with such order is true and accurate and you are an authorized user of the payment method provided. The receipt by you of an order confirmation does not constitute our acceptance of an order. Gentle No More retain the right to refuse any request made by you.
Prior to Gentle No More's acceptance of an order, verification of information may be required. We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation from us, for any reason whatsoever. Gentle No More reserve the right, without prior notice, to limit the number of items ordered and to refuse service to any customer.
(ii) Unacceptable orders, cancellation of orders by us
If a product is available through our Website, the basic assumption is that it can be produced. However, there are technical or other reasons to why Gentle No More may not accept or cancel your order during the entire ordering process, even after our acceptance of your order. Such reasons can be for example but not limited to the destination of the delivery you indicated in your order etc. In case we cancel your partial or entire order, we will contact you via email and at Gentle No More discretion, we will issue you a full refund for the cancelled item(s).
(iii) Product Price
All prices displayed on Gentle No More's Website are quoted in United States Dollars (USD). The prices displayed are valid only for the moment that they are displayed. Gentle No More reserves the right to make changes to all prices without prior notice and without incurring any obligations to you. Such change however will have no effect on orders completed before the posting of a new price. We do our best to prevent errors in the pricing. However, should an error occur, we are not bound by our offer and may cancel the order. Any monies paid related to that order would be refunded to you.
The actual price charged to overseas customers will be subjected to the exchange rate applied by the customer's credit or debit Card Company. Customers outside Singapore will also be liable for any customs/import duty, quotas, permits, product restrictions and other local requirements. These charges will not be reimbursed by Gentle No More. Customs policies vary widely from country to country, therefore you are advised to check the latest applicable local requirements in your country before placing an order.
When editing images for display on our Website, we always strive to produce the most realistic colours of the goods. However, people may perceive different colours as different devices renders colours differently. Such situations are not within our control and we cannot be held responsible for purchases made with the wrong perception of colours.
(v) Payment and Order Confirmation
The amount indicated on the ordering page is exclusive of delivery costs.
All payments for your order will be via our payment provider (PayPal or Stripe.)
For Paypal, you will be directed to the PayPal website. You can initiate your payment for your order using either your PayPal account or credit card on the PayPal website.
For Stripe, you can initiate your payment for your order using either your credit card on the within Gentle No More website at the final step during checkout.
We will not proceed into making of your order until we receive confirmation via PayPal or Stripe that the transfer of the amount indicated in the order confirmation form has been completed.
After accepting your order we will send you an order confirmation to the e-mail address associated with your order. The order confirmation will be effective as of the date on which the order confirmation is sent to you. If we cannot accept your order we will contact you by email. You should verify the details in the confirmation email. If there are errors, you should contact us as soon as possible via email.
(vii) Order status and cancellation of order
As our products are made by demand, cancellation of orders are not allowed after it goes into production. The status of your order will be reflected in your account.
Your order will be delivered to your shipping address. We will use our commercially reasonable efforts to deliver the product to the shipping address within the delivery time indicated in our delivery email. More importantly, we understand you want to receive your product(s) quickly.
Unless stated otherwise or for special promotion/projects, any delivery dates given by us are only best estimates.
Gentle No More carries no control over the respective local and international couriers and we are not liable for any damage and/or cost caused by the delivery process or delay in delivery once the parcel is with the courier.
In the event that the parcel is returned to us due to incorrect or invalid shipping address provided by the customer, a notification email will be sent to you from firstname.lastname@example.org. The full redelivery cost will have to be accounted for by the customer. Kindly note that any taxes or customs fees in regard to your parcel as deemed by your country's legal regulations are to be held responsible by the customer.
Parcels that were unclaimed 3 months from the order date will be forfeited.
3. GOODS RETURN AND EXCHANGE POLICY
If you wish to return any goods, you expressly understand and agree to conform the Goods Return and Exchange Policy and its terms and conditions stated below.
(i) Goods damaged on arrival
If you discover that your goods and/or packaging are visibly damaged on arrival, you should either write on the delivery note that the packaging is damaged, or refuse to accept the delivery. Please also contact us within seven (7) days with details of the damage (pictures and description etc). This will help us considerably in raising the matter with our appointed courier. Once we receive the damaged goods in our warehouse, we will then replace them for you.
(ii) Goods not as ordered
If you receive a different goods from what you have ordered, we strongly recommend that you notify us as soon as possible through our Contact page. Please also provide us with your Invoice Number and a clear snapshot of the mailing envelope (with the mailing label and postage stamps in view) together with the incorrect good received.
(iii) Exchange of goods
Requests for a one-time exchange are allowed only when you have received (i) an incorrect good, or (ii) a defective good. Requests for exchanges other than the above reasons will not be entertained.
Regardless of the reason of the request for exchanges, exchanges are allowed only if the good in concern is (i) unwashed and in a (ii) brand new and saleable condition. Requests for exchanges will be rejected if any of the above criteria is not met.
If all of the above criteria has been met, please contact us within seven (7) days from when the good was dispatched to request for an exchange. Requests for exchanges will not be entertained after seven (7) days from when the good was dispatched. All exchange cases opened (signified by the first reply from Gentle No More) will have 30 days to be completed, Gentle No More will not be obliged to follow up on the case on the 31st day.
All exchanges are assessed on a case-by-case basis and we reserve the right to exercise discretion in permitting or rejecting all requests for exchanges.
All goods can only be exchanged for the same design, as our products are made by demand. They cannot be exchanged for other products. However, in the event whereby the originally purchased good is out of stock in all colors, you will be offered an exchange for another good of your choice with the same or lesser price than the originally purchased good. You may choose to exchange it for a good of a higher price than the originally purchased good if you are willing to make a top- up of the difference in price.
(iv) Agreement upon returning
If you receive any goods and wish to return the goods to Gentle No More, you expressly understand and agree to conform to the following:
a. Gentle No More will accept goods sold only on Gentle No More Website.
b. Inspection of the products must be carried out on the date of acceptance of the product (ie within the day when you receive the goods itself).
c. All returns must be packaged in a manner to prevent any additional damage to the product.
(v) Return Policy
You can return any item to us within 7 days of receiving your original order, excluding sale items. Remember that the merchandise must be unworn and unwashed.
You can return your parcel using any postal service. The parcel remains your responsibility until it arrives to us - remember to ask for a sending receipt, so if your parcel goes missing in the mail, you’ll have a proof you have sent it.
Please note - You will need to cover the shipping costs yourself.
You agree to indemnify, defend and hold Gentle No More and its affiliates, distributors, dealers, agents and its and their employees harmless from and against all liabilities, claims, actions, demands, damages, costs and expenses (including reasonable attorneys fees) arising from or relating to any claims that result from your breach of these Terms and Conditions.
These Terms and Conditions, together with any other policies, guidelines, or FAQs posted by Gentle No More represents the complete and exclusive agreement relating to the subject matter hereof which supersedes any proposal or prior agreement, oral or written and any other communications between you and Gentle No More. No amendment of these Terms and Conditions shall be binding upon Gentle No More unless in writing and signed by Gentle No More. If any provision is held to be void or unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the invalidity or unenforceability of such provision shall not affect the validity or enforceability of any other provision of these Terms and Conditions.
